They’ve been at it for a long time, Google and Oracle. Yes they have.
Oracle is currently attempting to beat Google in a lawsuit, claiming the latter infringed upon patents and copyrights from the former’s code for Java. However, Oracle’s claim is that Google lifted 9 lines of code. Yeah, only 9 lines. Android has 15 million lines of code, to put things into perspective a bit. So far, Oracle and Google have given all they have to give, so to speak. They’ve both presented their closing arguments, and are waiting for the jury to present a verdict, and the judge a ruling. Oracle claims Eric Schmidt, Andy Rubin and Tim Lindholm had exchanged emails about, and were aware of, Oracle’s Java code. They also decided against Google’s claim of fair-use because Android, while free to license, generates revenue from ads, searches, and apps via Google Play Store.
Replying, Google said the SSO (Structure, sequence, and organization) of the 37 API apparently infringed upon were fraudulently filed to help support their case. We will never know if that’s true. Personally, I wouldn’t put it past them.
Google also claims Oracle’s former CEO Jonathan Schwartz (when they were Sun) gave permission to Google to use code without proper legal resources. The agreement wasn’t exactly formal, but it may just help Google’s case. It’s a dog-eat-dog world out there. In some cases though, it’s a bit one sided – as are many lawsuits involving Google. Google never seems to start these things, but I wonder if that could be a sign? Are they guilty?
If Google were forced to pay $1,000,000 for every percentage of stolen code, if it were actually stolen, it’s such a pathetically small number that makes the entire lawsuit seem pointless. Google would have to pay Oracle the sum of $60. Only if that were the case, of course.
